Crestfall Studio terms of service

1. About these terms

These terms are a contract between you and Anthology Interactive, LLC (doing business as Crestfall Studio). Crestfall Studio is a web platform for interactive fiction. You read, write, and play stories with characters that are created with artificial intelligence. In these terms, "we", "us", and "Crestfall Studio" mean that company, and "you" means the person using the service.

By creating an account, buying coins, or using any part of the service, you accept these terms. If you do not accept them, do not use the service.

These terms work together with the documents linked in the footer of every page: the privacy policy, the content policy, the refund policy, and the crisis protocol page. The content policy and the refund policy are part of this contract by reference.

Crestfall Studio is a website. There is no phone application, and we never ask you to install software to play.

2. You must be 18 or older

Crestfall Studio is for adults only. You must be 18 years of age or older to create an account, to use the service, and to buy anything.

When you sign up we ask for your date of birth before you reach any payment step. This is a real date entry, not a checkbox, and it is the condition of having an account at all. If the date you enter shows that you are under 18, we do not create an account for you and you cannot proceed.

Your account carries an adult flag set from the date of birth you entered. Checkout checks that flag before any purchase can be made.

Entering a false date of birth is a breach of these terms. If we learn that an account holder is under 18, we close the account. We do not knowingly collect information from children under 13, and we do not offer the service to them.

Nothing in this section changes our content rules. The rule against sexual or suggestive content involving characters who are or appear to be minors applies to everything on the platform, no matter who the account holder is.

3. Your account

You are responsible for your account, for keeping your sign-in details private, and for everything done through your account. Tell us at once if you believe someone else has gained access to it. One person, one account. Do not share an account, sell an account, or transfer an account to anyone else.

We may suspend or close an account that breaches these terms, that puts the platform or other users at risk, or that we are required to act on by law. Section 12 explains what happens when we do.

4. You are talking with artificial intelligence

Crestfall Studio characters are not human. They are generated by artificial intelligence, and the stories, characters, and replies you see are fiction.

We show this plainly. A quiet system line appears at the start of every conversation and repeats in a continuing conversation, so it is always clear what you are talking to. The line reads: "You're talking with AI. Crestfall characters and stories are fiction, created with artificial intelligence."

Because the characters are fiction, nothing they say is advice. Crestfall Studio characters are not therapists, doctors, lawyers, financial advisers, or any other kind of professional, and they do not provide therapy, counseling, medical care, or licensed mental health care. Do not rely on anything a character tells you as professional advice. If you need professional help, go to a qualified human being.

Generated output can be wrong, inconsistent, or unsuitable. We do not promise that any output is accurate, original, or fit for a particular purpose.

5. Content rules

Crestfall Studio is one platform for adults. There are no content tiers and no paid unlocks for different kinds of content. Thematic tags let you set what appears in your feeds; tags are preferences, not permissions.

Two rules are absolute and are enforced by our safety systems before anything is generated or published:

1. No characters who are or appear to be under 18 in any sexual or suggestive content. This applies to text and to images, to content you write and to content the system generates. The filter that enforces this rule is our own, its decisions are final, and there is no appeal that unlocks blocked content.
2. No content presenting a real, identifiable person in intimate scenes.

A separate rule sets the ceiling for images: no nudity and no depicted sexual acts in images. Mature themes in prose are allowed between adult characters. Crestfall Studio is a fiction platform, and fiction covers hard subjects.

You also agree not to use the service to: break the law; harass, threaten, or stalk another person; publish another person's private information; impersonate a real person in a way that deceives; infringe anyone's copyright, trademark, or other rights; upload malicious code; scrape, reverse engineer, or interfere with the platform or its safety systems; or resell access to the service.

The full list of what is and is not allowed, and how we apply it, is in the content policy. We state our content rules and the moderation tools we use in plain language so that you can read them before you agree to them.

6. Moderation, reports, and written reasons

Every content surface on Crestfall Studio carries a report control. Anyone can report content or behavior that breaks these terms or the content policy, and we review what is reported. You can also send a report to report@crestfallstudio.com.

When we act on content or on an account, for example by removing content, limiting its reach, suspending an account, or closing one, we send the affected user a written statement of reasons. That statement sets out what we did, the facts and the grounds we acted on, whether the decision was made by automated means, and how the user can respond or seek redress.

If you disagree with a decision, you can reply to the statement of reasons and ask us to look again. Blocks made by the minors safety filter described in section 5 are final and are not subject to this process.

We report to the authorities where the law requires it, including offenses that threaten the life or safety of a person, and we report apparent child sexual abuse material to the National Center for Missing and Exploited Children as United States federal law requires.

7. Nonconsensual intimate imagery

We do not allow intimate images of a real person published without that person's consent, including images created or altered with software or artificial intelligence.

If you are the person depicted, or their authorized representative, you can ask us to remove such an image. Use the report control or write to report@crestfallstudio.com. On a valid request we remove the image, and any copy of it we can identify, within 48 hours of receiving the request. We log the time the request is received so the clock is measurable.

8. Crisis support

Crestfall Studio runs a safety protocol for self harm and suicidal ideation. Detection is automated. When it fires, the conversation shows a referral to crisis services, and the protocol itself is published on our crisis protocol page, which is linked in the footer of every page.

If you are going through a hard time, support is available right now. In the United States you can call or text 988 to reach the Suicide and Crisis Lifeline. If you believe someone is in immediate danger, contact your local emergency number.

Crestfall Studio is not an emergency service and it is not a substitute for care from a qualified human being.

9. Coins

Coins are the in-product currency. You buy coins and spend them inside Crestfall Studio on the features that use them.

• Coins are a limited, personal, revocable license to use features inside Crestfall Studio. They are not money, not a deposit, not a stored value account, and not property. They have no cash value outside the service.
• Purchased coins may be gifted to another Crestfall Studio account. Free coins cannot be gifted or transferred. No coins may be sold, resold, traded, or exchanged for cash, except where the law requires otherwise.
• Prices and the contents of each coin pack are stated on the purchase page before you buy. Coins never expire.
• We may change prices and pack contents going forward. A change never removes coins you have already bought.
• If we close your account because you broke these terms, unspent coins are forfeited. If we close or suspend your account for any other reason, section 12 applies.
• Referral rewards are paid in coins, never in cash. A reward is void if it came from self-referral or any other abuse of the referral program.
• Refunds are governed by our refund policy and by any consumer rights the law gives you. You can ask for a refund of unspent purchased coins within 14 days of purchase, as the refund policy states; the terms of any subscription appear there too.

Payments are processed by our payment processor, Stripe. We do not receive or store your full card details. The name that appears on your card statement is CRESTFALL STUDIO. If we add or change a payment processor, we will update this section.

10. Your content and the license you give us

You keep ownership of the stories, characters, prompts, and other material you create on Crestfall Studio.

You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, adapt, format, display, and distribute your content. For content you keep private, that license is limited to operating, securing, and supporting the service, and it lasts as long as the content is on the platform and for a reasonable period afterward while copies clear our backups. For content you publish for other people, the license is perpetual, irrevocable, and sublicensable, and it covers making your content available to other users, letting them build on it, and promoting the service. Unpublishing or deleting published content does not withdraw it from existing remixes.

You confirm that you have the rights to the content you post, that it does not infringe anyone else's rights, and that it follows section 5 and the content policy.

Your content is never used to train AI models. The privacy policy states this, and states how the third-party model providers behind the characters handle your content.

You own the output that the artificial intelligence generates in response to your input, and you give us the same license over it as over the rest of your content.

We respond to copyright complaints. Send a copyright complaint to legal@crestfallstudio.com.

11. Our rights

Crestfall Studio, its software, its design, its brand, and everything we publish that is not user content belong to us or to our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the service under these terms. You get no other rights.

12. Suspension, closing an account, and what happens then

You can close your account at any time from your account settings.

We can suspend or close an account if you break these terms or the content policy, if we are required to by law, or if keeping the account open would put the platform, our payment processing, or other users at risk. Except where the law or an active investigation prevents it, we tell you what we did and why, in the written statement of reasons described in section 6.

If we close your account because you broke these terms, unspent coins are forfeited and no refund is due. If we close or discontinue the service, or close your account for a reason that is not your breach, we refund your unspent purchased coins, as the refund policy states.

13. Where Crestfall Studio is available

Crestfall Studio is offered in the United States and, when enabled, the European Union. Access from other regions may be restricted.

Purchases are available to buyers in the United States, and in the European Union once we have enabled the European Union. Access from the United Kingdom and Australia is blocked, and a user in a blocked region sees a block page rather than the service. We may add or remove regions as our compliance work progresses.

You may not use a proxy, a virtual private network, or any other method to get around a regional restriction. Doing so is a breach of these terms.

14. Terms for consumers in Germany and the European Union

This section applies to you if you are a consumer in the European Union, and its German paragraphs apply to you if you are a consumer in Germany. Where it conflicts with another section, this section wins for those users. Nothing in these terms takes away a mandatory right that your national law gives you.

Ordering. On a paid checkout shown to German users, the final button states that the order is subject to payment and reads "Zahlungspflichtig bestellen". No contract for a paid purchase is formed without it. The English button reads "Order and pay".

Value added tax. Where value added tax applies to your purchase, it is shown and collected at checkout.

Contact point. We publish a point of contact for users and for authorities on our contact page, which is linked in the footer of every page. Users write to support@crestfallstudio.com. Authorities write to legal@crestfallstudio.com.

Youth protection in Germany. Our German youth protection contact is legal@crestfallstudio.com, and it appears on our contact page.

Content rules and moderation. Our content rules and the moderation tools we use are stated in section 5, section 6, and the content policy. Our notice and action process, and the written statement of reasons we send on every moderation action, are described in section 6.

Online dispute resolution. The European Commission's online dispute resolution platform was discontinued in 2025. Crestfall Studio does not take part in a voluntary alternative dispute resolution scheme.

15. Disputes

Nothing in this section applies to a consumer in the European Union to the extent that mandatory law in that consumer's country gives them a different forum or a different right.

Talk to us first. Before starting any formal proceeding, write to legal@crestfallstudio.com and give us a fair chance to resolve the problem. Most disputes end here.

Arbitration. If we cannot resolve it, you and we agree to settle any dispute arising out of these terms or the service by binding individual arbitration rather than in court. The arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules. Any hearing takes place in your home county or by video.

Individual basis. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Small claims and injunctions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the service.

16. Disclaimers

The service is provided as it is and as it is available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that generated content will be accurate, original, or suitable for you.

Some jurisdictions do not allow these exclusions, and where that is so, they do not apply to you.

17. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the service.

Our total liability to you for all claims arising out of or relating to the service is capped at the greater of the amounts you paid to Crestfall Studio in the 12 months before the claim or 100 dollars.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or, in Germany and the European Union, liability under mandatory consumer law.

18. Indemnity

You agree to defend and indemnify us against claims, damages, and reasonable costs that arise from content you post, from your use of the service, or from your breach of these terms. This does not apply to the extent the claim arises from our own act or omission, and it does not apply where the law does not allow it.

19. Changes to these terms

We may change these terms. When we make a material change we will post the new version with a new version number and an effective date, and we will give you notice through the service before it takes effect.

If you keep using the service after a change takes effect, you accept the new terms. If you do not accept them, stop using the service and close your account. A change never takes away coins you have already bought.

20. Community spaces

Participation in the Crestfall Studio Discord server and any other community space Crestfall Studio runs is a privilege governed by the Community Guidelines. A paid account grants no right of access to a community space. Removal from a community space does not by itself affect your account.

21. General

If any part of these terms is held unenforceable, the rest stays in force. If we do not enforce a right, that is not a waiver of it. You may not assign these terms; we may assign them to a successor in a merger, acquisition, or sale of assets. These terms, together with the privacy policy, the content policy, and the refund policy, are the whole agreement between you and us about the service.
